ENVIRONMENTAL ATTORNEY DAVID LEVIN TO GIVE PRESENTATION AT NATIONAL COASTAL CONFERENCE

Attorney David M. Levin, a Shareholder with the Sarasota Law Firm, Icard, Merrill, Cullis, Timm, Furen & Ginsburg, P.A. has been invited to speak this week at the American Shore and Beach Preservation Association (ASBPA)’s National Coastal Conference in Long Branch, New Jersey.

Mr. Levin’s presentation is entitled “I’ve Got a Sinking Feeling, or The Turtles Shall Inherit the Beach”. The presentation is intended to bring to the attention of attending coastal scientists and engineers, marine contractors, governmental officials, and industry representatives the adverse impacts of the United States Fish and Wildlife Service’s recent action declaring much of the sandy beaches of Southeastern U.S. States, including Florida, as “Critical Habitat” for the Loggerhead Turtle.

As sea levels continue to rise, and as the source of sand for beach restoration purposes becomes less available, it will become increasingly necessary to consider the installation of structures along coastal shorelines to protect private property interests and governmental infrastructure from losses due to beach erosion.

The construction of coastal protection structures is highly regulated including the requirement of permits from the Florida Department of Environmental Protection. Among the regulations adopted by the FDEP is a prohibition against the construction of coastal protection structures in areas designated as “critical habitat” for marine turtles.

Much of Florida’s shoreline has been designated as “Critical Habitat” for the Loggerhead Turtle by the U.S. Fish and Wildlife Service. Therefore, the combination of the recently adopted federal regulations and those of the FDEP, it may become impossible for coastal property owners, including local governments, to protect their property and infrastructure with coastal protection structures.

Mr. Levin concentrates his practice in environmental and waterfront property law, including providing due diligence reviews associated with waterfront and near waterfront real estate closings.
